well i am applying for my adjustment of status after marrying a us citizen..i arrived here on the visa waiver and have overstayed that which the lawyer said was ok..as we married within the 3 months of the waiver expiring he said to us it was ok....
i want to go home to australia but was told that i need a travel permit which is submitted with my 485...
i find al this really confusing.. i was wondering if amyone nos if you can send in your travel permit before the 485???? and how long it takes?????
also i have found this site to be much more helpful than any bloody lawyer and the us goverment sites..
thanks guys i appreciate any help

you can apply for an advance parole...makes you sound like you're a jailbird huh?...I had an aussie friend who did that. It did take between 1-3 months for it to be approved though, may be faster now, not sure...if it's not faster, then you might end up with your GC adjustment faster in anycase...
I never left the country again until after i was a permanent resident, so not really up to date this day and age, as I became a citizen a few years ago and am done with INS for good now....

Have you looked up the Immigration website to see if they are behind in your area or up to date? I would do that first if i was you and just weigh it all up, if you can get away with more paperwork the better.

Den is correct you do have to apply for advamced parole, I went through the adjustment of status 2.5 years ago and it only took about 45 days to approve, (I never bothered with applying for the parole at the time) I applied for conditions to be lifted this year and that took maybe 60 days. USCIS has improved a great deal with the waiting times over the past few years it seems. If you can hang out a little to go home it would save you some $$$.
Take a look at http://www.visajourney.com you will find a lot of info there and also you can see how long it is taking to process other peoples cases in your area. As well as check the processing times at USCIS (although I found them to be very inaccurate in my case atleast, it said many many months and I didnt wait long at all)

Hahahaha thats the same way we did it. My guess is you would have to lodge them together because if you think about it if your paperwork isnt in for the 485 then they have no hold over you because in their minds your not here. Does that make sense ?

Hey there, your not a pain as Dahlsie said we have all been there.
Yes if you want to lodge the advanced parole it must be either with your I485 or after, they wouldnt know who you are if you just sent that and you would be denied.
